In almost all circumstances an attorney SHOULD only charge you if they’re SUCCESSFUL with your case and not until the end of the case – not having money available to you isn’t a good reason to not get help if you need it.

Hey, this is disability attorney Michael Liner, very often we get calls from people who are concerned about how can they afford to pay an attorney to help them with their disability case? They’re out of work, they don’t have any money. The good news is in almost all circumstances social security disability attorneys work on contingency, on a contingency fee basis. What that means is we work almost exclusively to get paid if and only if we’re successful in winning a disability case, okay. Social security has what’s called a statutory fee, we get paid, generally speaking, 25% of an individuals past due benefits, past due benefits is the money that’s awarded at the end of a disability case after somebody has been approved, that accounts for the period of time that social security should have been paying them, but wasn’t paying them while we were fighting their case. Another thing that’s important to know is that the statute that controls the attorney fees and social security cases says that the attorney fee cannot be more than $6,000 unless there’s appeals that go beyond the, beyond the initial ALJ level. So, in almost all circumstances you can afford an attorney to help you with a social security disability case, even if you don’t have money to pay an hourly rate or retainer, an attorney should only charge you if they’re successful with your case and not until the end of the case so you know *not having money available to you isn’t a good reason to not get help if you need it.*
