Legal malpractice case results in Massachusetts. Good afternoon, I’m attorney Neil Burns and I want to talk today about some of the case results we have, or at least the process for getting the results and what we do here in Massachusetts. I’ve been practicing law for 35 years. Most of that time here at 6 Beacon Street in Boston, and I’ve been undertaking representation of victims of legal malpractice for almost all of that time. And along with my partner, Roshan Jain, we have effectively and aggressively prosecuted hundreds of legal malpractice cases.
So what types of cases are they? They’re blown statute of limitation cases, they’re trust in the state cases, there’s conflict of interest cases. There are divorce cases. There are trusts and estate cases. There are so many different types of cases. There’s cases where the attorney screwed up on the legal procedure in a civil procedure, criminal procedure. There’s so many different types of legal malpractice, it makes it very interesting and intriguing and a lot of work. And in all those cases, we need an expert. What we do with those cases, typically, as we send out a demand letter, sometimes it’s a 93A consumer protection demand and sometimes not, and it lays out the case, it sets the evidence that we have against the attorney who committed the malpractice, and it gets us organized and focused. And usually we get a response and we see where their defense is going to be and we move forward from there. Sometimes we can settle from there. Sometimes we have to file suit. The lawsuit progresses in typical fashion and we usually know ahead of time what the problems, what the impediments are, and where the lawsuit will go.
In terms of case results, you can look on the website and see some of the case results, but you should understand that most of these cases that settle and even the ones that go to trial, we end up getting money through a settlement agreement. So we can’t generally write the names of the client, the dates of the settlement, and the amounts, because it’s against the settlement agreement. That’s part of the process in legal malpractice.
