Question:
How long do I have to pay child support?

Answer:
When we consult with a there children involved, one the questions that always comes up is child support. Whether or not that client is going to have to pay child support depends on a lot of factors. Certainly, one of the questions that they always ask is, “How long am I going to have to pay for child support?”

In the state of New Jersey, recently within the last few years, a law was passed that says child support is payable up to the age of 19. The initial cutoff date for child support is 19, however that can be extended until the age of 23. If the child remains a full-time student at school, past the age of 19, or is full-time enrolled in college, graduate school or vocational school, the child support can go up to the age of 23. Twenty-three is generally now the cutoff for child support in the state of New Jersey.

There is, in exceptional circumstances, discretion that a court could have to extend child support beyond the age of 23. I have not seen that happen yet, but there are cases out there that I think have allowed the child support to continue beyond the age of 23. Usually, that involves some sort of disability with the child, where the child is not financially independent and cannot be financially independent. Right now, 19 is the initial cutoff date, but it can go up to 23 if a child is enrolled full-time in college, vocational school or graduate school.
