Legal malpractice and unfair settlement practices by attorneys. We represented a woman who was assaulted, sexually assaulted in a prison by a prison guard. And it was an ongoing situation with many victims in that prison. They filed suit with an attorney and unfortunately the attorney developed a conflict of interest.
So our client, unfortunately, was given an attorney who did not prosecute her claims. And under the rules of civil procedure, her claims were closed out. Case was dismissed. And the lawyer deceived her year after year saying the case was ongoing. At some point, her mother figured it out and went to court, went to the federal court.
The attorney met her there. He said, I’ll file a new suit. It’ll be no problem. Don’t worry about this. And he filed a new suit right in front of her, but he never served the papers, which is of course required. You can’t be sued and not know that you’re being sued.
So the case was again dismissed and this time for good, of course. She came to us and said, I’ve lost all my rights. We filed suit for triple damages, triple damages. And we won. We won a million dollar judgment against the attorney. And the attorney didn’t pay. So we filed a second lawsuit against the attorney and we went to court in Cambridge District Court to prosecute the claims against that attorney for not making payment.
We had to make payments toward the million dollar judgment. The court incarcerated the attorney, the attorney was put in jail because of the claims that he was not following up on that he was not making payment after court.
