Do you wanna know if a tenant can sue a landlord for injuries ? Hi, I’m Micah Longo, I’m a practicing here in Davie, Florida.

The first question is where did you get hurt? You see a landlord has a duty to maintain the common areas in a clean and safe condition. So, if you tripped and fell in the parking lot or slipped and fell in the lobby, you may have a against the landlord for your injuries, assuming the common areas where not properly maintained or the landlord failed to properly warn a danger.

It gets a little trickier if you were hurt inside your rental. In Florida, a landlord has a continuing duty to exercise reasonable care to repair dangerous defective conditions upon notice of their existence by the tenant. So, if you slipped and fell inside your rental because of a leaky air conditioner or some other dangerous condition and you landlord was made aware of the condition and failed to fix the problem, then you may sue your landlord for your injuries. Because of this, I always recommend tenants make all their complaints to landlords in , sent certified mail-return receipt. This way the landlord cannot dispute they had adequate notice of the problem.
